12.1 Zendal owns and operates the software and is comitted to protecting the privacy of its users. Zendal stands behind the belief that personal information provided by our users should only be used as accorded by this agreement.
The collecting and automatic treatment of personal data has a strictly contractual purpose; the use of personal data is necessary to accomplish the service management, invoicing, contracting as for the accomplishment of informing, educating and for commercial purposes-the latest one is always clearly identified as such and for any other use considered as usual practice in our business activity.
All your data will be used as depicted above.
12.2 As established by the Law 15/1999 of 13 December on the Protection of Personal Data, Zendal adopts all the necessary technical and management means to guarantee the security, integrity and confidentiality of the mentioned data.
12.3 The user will be entitled to, at any moment, using his legal rights regarding the access, opposition or rectification and cancellation as recognized by the Law of Personal Data Protection (quoted above). The user may exercise his/her legal rights through the software system or by any of the communication means described as valid in this agreement/ contract.
12.4 As stipulated in the section 11.2 of this Agreement, Zendal, accordingly with the LOPD, will act as comissioner of data treatment therefore will not use the data in any other way than the strictly explained in this agreement/ contract; the data will not be facilitated to third parties even in case of the data conservation, without the explicit users' request.
In the event of any indication by the person which is responsible for the data treatment referent to the implementation of special security measures in the server, it will be necessary to contact ZENDAL to regulate new conditions, only in case it proves as necessary, remaining thus subject to this contract.
12.5 Zendal is not responsible for the users' failure to comply with obligations (liabilities) referent to the Law on the Protection of Personal Data. Both parties here involved should meet the norms of the Law on the Protection of Personal Data in their activities, however, by this agreement/contract only the parties mentioned are involved in obliging the norms between each other.
12.6 The user declares that all the data given to Zendal is thruthful and correct; the user furthermore is obliged to keep all the information updated and correct, notifying Zendal of any changes. The user is responsible of any conflicts/detriments which could result if the information is false.
